# **Construction Dispute Resolution: Mediation and Arbitration**

Construction disputes are common but litigation is expensive and slow. Mediation and arbitration offer faster, less costly alternatives. Understanding your options helps resolve conflicts and keep projects moving.

Construction disputes are virtually inevitable on complex projects. Design ambiguities, changed conditions, schedule delays, payment disagreements, and defective work claims arise regularly. In Ontario alone, the construction industry generates thousands of formal disputes annually. The question is not whether disputes will occur, but how efficiently they will be resolved. The traditional approach of going to court (litigation) is expensive, slow, adversarial, and damages business relationships. Alternative dispute resolution (ADR) methods, particularly mediation and arbitration, resolve disputes faster, cheaper, and with better outcomes for all parties.

## Types of Construction Disputes

| Dispute Type | Typical Cause | % of Construction Disputes |
| --- | --- | --- |
| Payment disputes | Unpaid invoices, holdback disputes, change order pricing | 35-40% |
| Delay and disruption | Schedule delays, acceleration costs, liquidated damages | 20-25% |
| Defective work | Work not meeting specifications, building code violations | 15-20% |
| Scope disputes | Disagreement on what is included in the contract price | 10-15% |
| Design errors | Errors or omissions in drawings/specifications | 5-10% |

---

## Resolution Methods Compared

| Method | Time | Cost | Binding? | Privacy | Control |
| --- | --- | --- | --- | --- | --- |
| Negotiation | Days-weeks | Minimal | Only if agreed | Private | Full |
| Mediation | 1-3 months | $5,000-20,000 | No (voluntary settlement) | Private | Parties decide |
| Arbitration | 3-12 months | $15,000-75,000+ | Yes (award is enforceable) | Private | Arbitrator decides |
| Litigation (court) | 1-5 years | $50,000-500,000+ | Yes (judgment) | Public record | Judge/jury decides |

## Mediation

### How It Works

1. Parties agree to mediate (often required by the contract before arbitration or litigation)
2. An independent, trained mediator is selected (often a construction lawyer or retired judge)
3. Each party prepares a brief outlining their position, the facts, and supporting documents
4. Mediation session: the mediator meets with both parties together, then separately (caucuses), helping each side understand the strengths and weaknesses of their position
5. Settlement: if both parties agree on a resolution, a written settlement agreement is signed. This is a binding contract.

> **Mediation Success Rate:** Construction mediations achieve settlement 70-80% of the time. Even when mediation does not result in a full settlement, it often narrows the issues and leads to a faster resolution through arbitration or negotiation.
### Advantages of Mediation

- Parties control the outcome (not imposed by a judge or arbitrator)
- Preserves business relationships (less adversarial than court)
- Confidential (disputes and terms do not become public record)
- Fast (typically scheduled within 30-60 days of request)
- Cost-effective (mediator fee split between parties, typically $3,000-10,000 total)

---

## Arbitration

### How It Works

1. The arbitration clause in the construction contract specifies arbitration as the dispute resolution method
2. An arbitrator (or panel of three) is selected, typically with construction industry expertise
3. Parties exchange documents and may conduct limited discovery
4. A hearing is held (similar to a trial but less formal, typically 1-5 days)
5. The arbitrator issues a written award, which is legally binding and enforceable by the courts

### Ontario Construction Act Provisions

- **Prompt payment:** The Ontario Construction Act (2019 amendments) introduced prompt payment and adjudication provisions
- **Adjudication:** A fast-track (46-day) dispute resolution process for payment disputes on construction projects
- **Lien rights:** Preserved regardless of dispute resolution method

> **AVANORTH Dispute Practice:** Our contracts include a tiered dispute resolution clause: first direct negotiation (14 days), then mediation (30 days), and only then arbitration if mediation fails. This approach resolves 90%+ of disputes before they reach formal proceedings. We maintain clear documentation, detailed change order records, and regular written communication with all parties, which provides the evidence base needed for efficient dispute resolution. Our goal is always to resolve disagreements fairly and quickly so the project continues.
